Understanding Your Rights as a Consumer

While most issues between a therapist and a client receiving therapeutic services can be addressed directly, some situations might require an escalated response. In compliance with requirements of the State of Texas, information is provided below to assist consumers interested in lodging a formal complaint against a licensed mental health professional in Texas. 

Notice to Consumers

Going into effect on September 1, 2025, House Bill 4224 (89th Regular Session) requires via the Texas Health and Safety Code § 181.105 (2025) that licensees prominently post these rights on their website and at any facility. As required by the above-mentioned bill, this page serves to inform those consumers of services provided by licensee Audrey Zatopek at Mental Health Institute, PLLC of their rights to request healthcare records, to contact the Texas Behavioral Health Executive Council (BHEC), and to file a consumer complaint. 

Requesting Your Health Care Records

 As a consumer of mental health care services from Audrey Zatopek at Mental Health Institute, PLLC, you have the right to request a copy of your mental health care records. To request your records, please submit a written request to Audrey Zatopek at Mental Health Institute, PLLC. Requests may be made via email or secure client portal. Records will be provided in accordance with Texas law and applicable privacy regulations. When making a request, please provide your full name, date of birth, contact information, and specify the records being requested. If you have questions about accessing your records, please reach out for assistance. 

Consumer Complaints

As requested above, please bring any complaints you have to Audrey Zatopek first by phone, email, secure client portal messaging, or a Contact form, and you will be contacted as soon as possible to address your concern(s). Should you believe that a formal complaint is warranted for her or another licensed mental health professional in Texas, as a consumer you may contact the Texas Behavioral Health Executive Council (BHEC), Texas Health and Human Services (HHS), and Texas Office of the Attorney General as is applicable. Instructions for how to file such complaints are provided below. 

Contacting Licensing Boards: Texas BHEC and HHS

The Texas BHEC is an oversight authority that regulates licensed mental health professionals in Texas; this entity investigates and prosecutes professional misconduct committed by marriage and family therapists, professional counselors, psychologists, psychological associates, social workers, and school psychologists.  By comparison, the Texas HHS is similarly an oversight authority that enacts these same duties but for chemical dependency counselors and sex offender treatment providers. 


If you believe a clinician has violated their code of ethics and/or scope of their licensing regulations, please contact the licensing board. Although not every complaint against or dispute with a licensee involves professional misconduct, the Texas BHEC and Texas HHS may be contacted to file a complaint as is indicated. You may also contact these entities if you have questions about licensure or professional standards.

Filing a Consumer Complaint: The Attorney General

If you wish to file a consumer complaint regarding mental health services received or having been a victim fraudulent business practices in the State of Texas, you may do so through the Texas Office of the Attorney General; their website provides information about Consumer Rights, Consumer Protection, and instructions for how to File a Consumer Complaint online.

Before filing a complaint, it is important to do the following:


  • Read about the types of complaints you can file and pick the complaint form that addresses your problem.
  • Take a moment to prepare and have important information on hand.
  • Learn what information you will need to include in your complaint.
  • Know that under Texas law your complaint is open to the public.
  • Remember that the Office of the Attorney General cannot give you legal advice.
